The owner of the mark coincides with the generic domain myschool.com opened an administrative proceeding in the NAF to try to get the domain (Case Foresight.com v. Joseph L. Carpenter and Andy Booth .) operates under the domain myschool411.com .
The previous owner had offered the domain to the complainant Joseph L. Carpenter for $ 25,000 and then by $ 15,500. Both offers were rejected. The current owner of the domain and the defendant, Andy Booth, bought it for $ 12,700.
It is alleged that the domain is used for the sole purpose of displaying advertising links and generate revenue through PPC. Consequently, the defendant would not have rights or legitimate interests in the domain. Bad faith would be given by the fact that a registered domain before the trademark, ignore the communications C & D and the intention to interfere in the business of the applicant.
The defendant contends that the domain is composed of generic terms that describe the services he offers and was not aware of the complainant's mark when it was purchased.
